These Terms & Conditions apply to driving tuition and related services arranged through Just Drive. Please read them carefully before making a booking or payment.

By making a booking, you agree to the terms that apply to the service you have booked. Nothing in these Terms & Conditions affects your statutory consumer rights.

Driving tuition is provided by independent, self-employed driving instructors.

Your contract for the provision of driving tuition is between you and your individual instructor.

Just Drive is not itself the provider of the driving tuition.

Where Just Drive accepts an enquiry, arranges a booking, provides information, receives or processes payments, passes payments to an instructor or assists with administration, Just Drive acts as a disclosed booking and administrative agent between you and your instructor.

Your instructor remains responsible for the delivery and professional standard of your driving tuition.

All instructors working through Just Drive are fully qualified DVSA Approved Driving Instructors (ADIs). Just Drive does not provide lessons using trainee instructors.

You must hold a valid driving licence which legally permits you to receive the tuition booked.

You must provide your instructor with evidence of your driving licence before your first lesson if requested.

If you are unable to provide satisfactory evidence that you are legally entitled to drive, your instructor may refuse to conduct the lesson and the lesson may still be chargeable.

You must tell your instructor about any change that could affect your entitlement to drive.

You must meet the legal eyesight requirements for driving.

If you require glasses or contact lenses to meet the required eyesight standard, you must wear them whenever you drive.

You must not attend a lesson while affected by alcohol, illegal drugs, medication or any physical or medical condition which makes it unsafe or unlawful for you to drive.

Your instructor may refuse to begin or may terminate a lesson if they reasonably believe it would be unsafe or unlawful for the lesson to continue.

Where a lesson cannot proceed because the pupil is unfit to drive, the booked lesson may be charged.

You are responsible for complying with any legal obligation to notify DVLA about a medical condition.

Please tell your instructor about any additional support or reasonable adjustment that may assist you during your tuition.

Just Drive and its instructors aim to provide tuition fairly and will consider reasonable adjustments where appropriate.

Lesson dates, times, duration and meeting points are agreed between you and your instructor.

Submitting an enquiry through the Just Drive website does not guarantee that an instructor or particular lesson time is available.

A booking is confirmed only when the relevant arrangement has been accepted and confirmed.

Instructor availability may vary according to location.

The price applicable to your tuition will be confirmed when you make your booking.

Payment instructions will be provided directly by Just Drive or your instructor as applicable.

For security reasons, Just Drive does not publish its bank account details on the website.

Always check that payment instructions are genuine before transferring money.

Where Just Drive receives payment on behalf of an instructor, it does so in its capacity as agent.

Where payment is made directly to the instructor, that payment forms part of your tuition contract with that instructor.

Weekly driving lessons are arranged between you and your instructor according to availability.

You and your instructor are responsible for agreeing the timing, location and duration of individual lessons.

Please give at least 48 hours' notice if you need to cancel or rearrange a weekly lesson.

Where less than 48 hours' notice is given, your instructor may charge the full price of the booked lesson where it is reasonable to do so.

If your instructor cancels a lesson, you will not be charged for tuition that has not been supplied. Any payment already allocated to that lesson will be rearranged, credited or refunded as appropriate.

This section applies specifically to prepaid blocks of normal weekly driving lessons.

Block-booking discounts are offered on the basis that the agreed number of lessons will be taken.

If you purchase a block booking and subsequently decide to cancel the remaining unused lessons:

a. Any lessons already taken will be recalculated at the standard hourly lesson price that applied when the block booking was purchased, rather than at the discounted block-booking rate.

b. A £25 administration fee will be deducted.

c. The remaining balance will then be refunded.

The calculation will therefore be:

Amount originally paid
minus lessons already taken at the standard hourly rate
minus £25 administration fee
= balance to be refunded.

Example: if you purchased lessons at a discounted block-booking rate but cancelled after using part of the block, the lessons you have already received will be charged at the normal standard hourly price before the refund is calculated.

Refunds will normally be returned to the person or account from which the original payment was received.

This policy applies to a customer's voluntary cancellation and does not limit any statutory cancellation, refund or consumer rights that may apply.

If your instructor is unable to provide prepaid lessons and no suitable alternative arrangement is agreed, the appropriate balance for tuition not provided will be refunded.

Intensive and semi-intensive courses involve an instructor reserving a substantial amount of teaching time specifically for one pupil.

Course dates, hours and proposed lesson schedules will be agreed before the course begins.

The course timetable may occasionally need to change because of circumstances including instructor illness, vehicle problems, practical-test changes, severe weather or other matters outside reasonable control.

Booking an intensive course does not guarantee that a practical driving test will be available during or immediately after the course.

An intensive driving course also does not guarantee that a pupil will reach test standard within a particular number of hours.

Progress depends upon the individual pupil.

Intensive and semi-intensive driving course payments are non-refundable once the booking has become committed and the instructor's time has been reserved, subject always to the pupil's statutory consumer rights.

This is because an intensive-course instructor reserves a substantial block of diary time specifically for the pupil and may be unable to replace that booking at short notice.

If you cancel, fail to attend, change your mind or choose not to complete the course after the course has been committed, payments already made will not normally be refunded.

However, nothing in these terms allows Just Drive or an instructor to retain money where doing so would be unlawful or unfair.

Where consumer law requires a refund, or where the amount retained would exceed the reasonable loss arising from the cancellation, the appropriate adjustment or refund will be made.

If Just Drive or the instructor is unable to provide the booked course and no suitable alternative arrangement is agreed, you will be entitled to an appropriate refund for tuition that cannot be provided.

Where a statutory cancellation right applies to a booking made online, by telephone or otherwise at a distance, that right takes priority over this section.

If you expressly request that tuition begins during any applicable statutory cancellation period, you may be required to pay for tuition or services already supplied to you, to the extent permitted by law.

Requests to change an intensive-course date must be made as early as possible.

A change cannot be guaranteed because the instructor will have reserved the original course dates.

Where the instructor can reasonably accommodate a change, a revised date may be agreed.

Where a requested change amounts to cancellation of the original reserved course, the Intensive Course Cancellation and Refund terms above may apply.

You are responsible for ensuring that any required theory test has been passed and remains valid.

You must provide accurate information about any theory test or practical driving test that you have already booked.

Failure to provide relevant information may affect the arrangements that can be made for your course or practical test.

Just Drive cannot guarantee the availability of a particular DVSA practical driving-test date or test centre.

A practical test should only be taken when the pupil has reached an appropriate standard of safe and independent driving.

DVSA may cancel, move or change driving tests for reasons outside the control of Just Drive or your instructor.

Neither Just Drive nor the instructor is responsible for a DVSA cancellation caused by matters such as examiner availability, industrial action, severe weather or other circumstances outside their reasonable control.

Use of an instructor's car for a practical driving test is subject to the instructor being satisfied that the pupil can use the vehicle safely.

If the instructor reasonably considers that the pupil has not reached a safe standard, they may refuse the use of their vehicle for the practical test.

This decision will be made on safety grounds.

Any charge for the instructor's time and use of the tuition vehicle for the test will be confirmed beforehand.

Unless expressly stated otherwise as part of a particular booking, DVSA theory and practical driving-test fees are separate from driving tuition.

Where Just Drive assists with test arrangements, this does not amount to a guarantee that a test will be available on a particular date or at a particular test centre.

If you arrange or change your own practical driving test, you must tell your instructor as soon as possible.

You should not assume that your instructor or their vehicle will be available for a test that has been booked without first checking with them.

Just Drive cannot guarantee that a particular instructor or tuition vehicle will remain available indefinitely.

If an instructor becomes unavailable because of illness, vehicle problems or other circumstances outside reasonable control, Just Drive may help you find another suitable instructor where possible.

You are not obliged to accept a replacement instructor.

If you agree to continue tuition with another independent instructor, that instructor will become the provider of your subsequent driving tuition.

Occasionally an instructor may be delayed by traffic or circumstances outside their control.

Where reasonably possible, the instructor will either extend the lesson to compensate for the lost time or add the time to another lesson.

You must be available at the agreed location and time for your lesson.

If you fail to attend or are not available for the lesson without giving sufficient notice, the lesson may be treated as a late cancellation and may be charged.

Abusive, threatening, discriminatory, violent or seriously inappropriate behaviour towards instructors, staff, driving examiners or members of the public will not be accepted.

An instructor may terminate a lesson immediately where continuing the lesson would create a safety risk or where serious abusive or threatening behaviour occurs.

Any financial consequences following termination will be considered fairly in light of the tuition provided and any reasonable loss incurred.

If an instructor reasonably believes that a pupil is under the influence of alcohol, illegal drugs or another substance that could make driving unsafe, the pupil will not be permitted to drive.

The affected lesson may be charged.

Serious or repeated incidents may result in future tuition being refused.

Just Drive tuition vehicles are non-smoking environments.

Smoking or vaping is not permitted inside an instructor's tuition vehicle.

The pupil remains responsible for following the instructor's reasonable safety instructions.

The pupil is responsible for fines, penalties or consequences resulting from their own unlawful actions while driving, except where responsibility legally rests elsewhere.

Nothing in these Terms & Conditions excludes or limits liability where doing so would be unlawful.

Neither Just Drive nor an instructor is responsible for loss caused solely by circumstances genuinely outside their reasonable control.

Nothing in these terms excludes the pupil's statutory rights or any legal responsibility for services that are not supplied with the standard required by law.

Where Just Drive currently offers gift vouchers, they are subject to instructor availability and service-area coverage.

A voucher may only be used by the person named on it unless otherwise agreed.

Vouchers cannot normally be exchanged for cash.

A voucher must be used within any validity period clearly stated on the voucher when it is purchased.

If lesson prices change after a voucher is purchased, the cash value paid for the voucher will remain available, but the number of lessons that value purchases may change unless the voucher expressly guarantees a particular number of lessons.

Nothing in these voucher terms affects any statutory rights that apply.

Where an introductory offer is available, its specific conditions and price will be clearly stated when the booking is made.

Unless otherwise stated, introductory offers are available to new Just Drive pupils only and cannot be combined with another introductory offer.

Just Drive may withdraw an offer for future bookings, but this will not remove rights already agreed for a confirmed booking.

Personal information supplied to Just Drive or an instructor may be used where necessary to:

administer your enquiry or booking;
arrange and provide driving tuition;
communicate with you;
process or administer payments;
deal with enquiries, complaints or disputes; and
comply with legal obligations.

A separate Privacy Policy should explain in more detail how personal information is collected, used, stored and shared.

Marketing communications will only be sent where permitted by applicable law, and recipients can unsubscribe or object to direct marketing.

From time to time, Just Drive may ask successful pupils whether they would like to provide a photograph, video, testimonial or review.

Participation is optional.

Where promotional use requires consent, the material will only be used for those purposes in accordance with the permission given.

If you have a concern about your driving tuition, you should normally raise it with your instructor first so that they have an opportunity to resolve the matter.

As the instructor is the provider of your driving tuition, complaints concerning the delivery of lessons are primarily matters between you and your instructor.

Where appropriate, Just Drive may assist communication between the parties.

Just Drive takes reasonable care when preparing website information but may update the content, services and prices from time to time.

You may print or copy material from the website for your own personal and non-commercial use.

Just Drive's name, branding, photographs and other protected material must not be commercially reproduced without permission.

The Just Drive website may contain links to external websites.

Just Drive does not control third-party websites and is not responsible for their content, availability or privacy practices.

Just Drive may update these Terms & Conditions from time to time.

Changes will apply to future bookings from the date the revised terms are published.

A change to the website terms will not retrospectively remove contractual or statutory rights that already apply to an existing booking.

These Terms & Conditions are governed by the laws of England and Wales.

Nothing in this provision removes any consumer right to bring proceedings in another court where applicable law permits it.
