Your use of the Just Drive website is subject to these terms, and by using the Just Drive website you show your agreement to such terms. If you do not agree to these terms, please do not use the website.

Disputes arising in relation to the same shall, unless otherwise expressly agreed, be subject to the exclusive jurisdiction of the courts of England and Wales.

Changes to terms and records of agreements

Just Drive reserve the right to change these terms and conditions at any time by posting changes on the website. It is your responsibility to review the website terms and conditions regularly to ensure you are aware of the latest terms and conditions. Your use of this website after a change has been posted will be deemed to signify your acceptance of the modified terms and conditions. 

We recommend that you print off and retain for your records a copy of these terms and conditions from time to time and a copy of any terms and conditions relating to any product or service which you apply for on-line, together with any related application form completed and submitted. 

Any amendment to terms and conditions must be agreed in writing by us, or, if appropriate, by the relevant company with whom you contract.

Learner driver – Terms and Conditions

It is the student’s responsibility to notify Just Drive of the following when making a booking:-

  • Your driver number. 
  • Your theory certificate number & date passed
  • Your pickup address if different to home address
  • Any unavailable dates and/or times.
  • Any special requirements.
  • Any medical condition
  • Any condition which could affect the driving course.
  • Any condition which could affect the driving test.
  • Dates of any tests already booked which would conflict with the course you are booking.

Eyesight 

Your eyesight must be up to standard. You must wear glasses or contact lenses every time you drive if you need them to meet the ‘standards of vision' for driving, You could be prosecuted if you drive without meeting the standards of vision for driving. It is highly advisable to have your eyesight checked before beginning any course.

Introduction

The contract for driving tuition is solely between you and your instructor (your ‘Instructor’) who is a self-employed franchisee of Just Drive.

These Terms and Conditions apply to that contract.

Just Drive nor are party to that contract. They are only mentioned in these Terms and Conditions where they act in a disclosed agency capacity between you and your instructor.

Paying for lessons

You can pay for tuition in advance via one of the following methods:

  • BACS to Just Drive using first 8 digits of your licence number as reference to the following account;

       A/C No - 17963048

  • PAYM

You agree that monies paid in advance by you or on your behalf for driving lessons to be provided in the future will be paid to your instructor.

Just Drive will arrange payment to your Instructor on your behalf once your Instructor has provided you with the prepaid driving lessons. Lessons delivered to you will be redeemed against your oldest prepaid lesson payments.

Where receives your payments for driving tuition, makes bookings with, or supplies any information or documentation to you, or arranges payments to your Instructor, they act solely in a disclosed agency capacity between you and your instructor.

Alternatively, you can pay your Instructor directly (Any cheques must be made payable to your Instructor. Your instructor will confirm which payment methods they can accept). If you pay your Instructor directly you should obtain a receipt. As Just Drive is not a party to the contract between you and your Instructor it accepts no responsibility for any payments you make directly to your Instructor.

You can only pay for lessons via the methods outlined above. 

You can not pay for lessons via any other method and neither, Just Drive or your instructor accept any liability for monies or lessons paid for by any other method than those outlined above.

The lesson price per hour is subject to change at any time.

It is your responsibility to provide your Instructor with proof that you have a valid licence to drive, before the commencement of your first lesson.  If you fail to provide this proof, your Instructor is entitled to refuse to conduct the lesson but still charge you.


Redeeming prepaid lessons

  • You and your Instructor are responsible for agreeing on all matters relating to the timing, location and duration of individual lessons. Where you arrange lessons through Just Drive’s booking office or via Just Drive’s website, Just Drive provides these services solely as agent for your Instructor.
  • You must present your valid UK provisional driving licence (or other appropriately valid licences) to your Instructor prior to the start of your initial lesson. Should you fail to do so, your Instructor reserves the right to refuse to provide you with tuition or to cancel any lessons you have booked with them, and you may be charged the full value of that lesson.
  • You must notify your Instructor of any matters existing at any time that may affect your ability or entitlement to have driving tuition, for example, but not limited to, any lack, or loss, of a valid driving licence.
  • The value of driving lessons your Instructor will deliver to you is equal to the value of the monies received from you. Your Instructor does not know when you will redeem your prepaid lessons and therefore they can’t guarantee you that they will be available each time you choose to request a driving lesson.
  • Lesson prices vary throughout the UK and therefore the lesson prices quoted to you when you pay are only applicable in the postcode area where tuition was purchased. If you subsequently choose to take a lesson in an alternative location, the prevailing lesson price in the new area could be different from the original lesson price quoted when your monies were received. In such an event the number of hours of driving lessons purchased will be adjusted up or down to reflect the change in the lesson price.
  • Following a change in price per hour for lessons and other than in the circumstances noted immediately above in respect of a change of area for tuition delivery, lessons purchased prior to such a change will be delivered at the price originally paid.
  • You must give at least 48 hours notice to your Instructor if you wish to cancel or re-arrange booked lesson. Failure to do so may result in your Instructor charging you the full amount for that lesson.
  • You understand and acknowledge that lesson fee paid to for prepaid lessons must be applied to lessons by you within six months of the date of your original payment. 
  • You acknowledge that you will not be entitled to a refund of any lesson fees not applied to lessons, or to utilise lesson fees paid for booking further lessons, after the expiry of this period. 
  • Any lesson fees that become non-refundable may be applied by at its sole discretion, and will ordinarily be paid to Just Drive within one month of such fees becoming non-refundable. If at any point during this six month period you determine that you do not wish to take any of the prepaid lessons, you are entitled to a refund of lesson fees equal to the value of any prepaid lessons not taken (exceptions may apply on specific offers, see individual offer Terms & Conditions for details).
  • For security reasons, any refund of prepaid lessons will be made back to the person/account from which the original payment was taken. If for any reason those details have become invalid, before any refund is made, your Instructor (through its agent ) reserves the right to verify the identity of the person requesting the refund, and seek verification of the validity of any alternative bank account details provided.
  • Following the delivery of each lesson, your Instructor will confirm to Just Drive that the lesson has been delivered and then the Instructor will automatically receive payment for the lesson delivered and your account with adjusted accordingly.
  • Any disputed transaction will be promptly and fully investigated by Just Drive. The result of the investigation will be communicated to both parties. No payment will be made to either party until the investigation has been completed to the satisfaction of Just Drive.

Transferring prepaid lessons

You cannot sell or transfer lessons which have been purchased in your name to any other person.


Liability

Your Instructor, Just Drive and/or are not liable to you for any loss or damage caused where, and to the extent that:

  • there is no breach of a legal duty owed to you by the relevant person or body
  • such loss or damage is not a reasonably foreseeable result of such a breach of a legal duty
  • any such loss or damage, or increase in the same, results from any breach or omission by you
  • any such loss or damage results from circumstances or matters outside of the reasonable control of the relevant person or body

Your Instructor, Just Drive and/or shall not, in any event, be liable for losses relating to any business interests you may have including, without limitation, lost profits, loss of opportunity or business or business interruption.

You are reminded that neither Just Drive and/or are parties to the contract for driving tuition itself, which is between you and your instructor. This does not affect any liability that Just Drive and/or may have for any loss or damage you may incur which is caused directly as a result of any breach (including negligence) by it or them of any legal duty owed by it or them to you.

Nothing in these Terms and Conditions will affect any statutory rights you may have as a consumer.

Intensive Driving Courses Terms & Conditions

As we arrange short notice tests, we are UNABLE to guarantee which test centre your practical test will be held at. We always try for the closest, but this is not always possible.

  • All courses booked with Just Drive, are under the provision that you understand you are forming a contract between yourself and the instructor,  in regards to the delivery of the course and its hours. 
  • The instructor is a self-employed franchisee of Just Drive. 
  • Any balance payment dispute, claim or discussion, regarding tuition, course hours or any other issues should, therefore, be taken up with the instructor. 
  • The company cannot be held liable for any compensation claim from either instructor or student, nor can it be held responsible for any traffic law violation on the part of either instructor or the student.
  • Just Drive acts as an agent.
  • If you choose to commence your course in a manual car, you will have to complete the course, as the instructor has allocated his time for you. You will not be able to change to an automatic.
  • Just Drive will not be held responsible for a pupil not providing any relevant information that could affect either the driving course or driving test.
  • Failure to forward your theory certificate number and date of passing, or the fact that you have failed the theory, or failure to respond to any reminders, will mean we may well be unable to book a practical test for the final day of your course.
  • We generally require at least  2 weeks in between theory test and practical course.
  • Your driving test may be arranged for any day of your course week.
  • If you fail your theory test, you will attempt to book another before your practical course, but be aware this greatly reduces the amount of time we have to book your practical test, which may mean you will be unable to have your practical test on the final day of the course.
  • If you were to fail the theory test, (or not take it for whatever reason), the practical course will still go ahead except for the final day, which we will hold back until you have passed the theory. This is at the discretion of the instructor taking the course.
  • If you do not go ahead with the original course date, your deposit will be forfeit.
  • If the student cannot take their theory test due to not having the correct licence, the instructor reserves the right to go ahead with the majority of the training, reserving some, for when the theory test has been taken and passed.
  • You must also hold a valid provisional licence for the category B - Car Licence. If you do not reach the required standard by your test day, you may be refused the use of our Instructors car incurring the loss of test fee. The Instructors decision is final,  
  • Just Drive/instructor cannot be held responsible for bad weather cancellation of tests. We will try our best to reschedule to suit both the pupil and instructor, but please be aware this can in some instances lead to delays.
  • Just Drive does not teach test routes or areas, instead, we teach you how to drive, being able to recognise different situations and how to deal with different types of junctions.
  • Availability of courses and instructors shown on the site is meant as a guide only. We reserve the right to offer alternate dates and instructors. Our instructors may be from a different area to the one you live in.
  • Any toll charges, congestion charges are to paid by the student, in cash to the instructor.
  • Just Drive reserves the right to refuse a course booking for whatever reason.
  • Note - We cannot guarantee a Driving Test for the end of your driving course, however, Just Drive currently has a 97% success rate of achieving this.


Guaranteed Pass Course 

  • This course is not for the people over the age of 25 or nervous drivers or people with Tachophobia, Anxiety, Depression, Dyspraxia, Dyslexia, ADHD, OCPD, ASD or any behavioural or mental health issues.
  • If after the initial 35-hour course, the instructor considers it would not be safe for the pupil to take the practical test, the student will have to pay for additional lessons until they reach a safe standard.
  • The pupil must inform us of any condition including OCPD, ASD, driving anxiety, dyslexia, dyspraxia, tachophobia or any other circumstance or previous history which might make it effectively, almost impossible to pass the test. Failure to do so will invalidate the guarantee.
  • If you choose to commence your course in a manual car, you will not be able to change to an automatic or vice versa.
  • The pupil must make themselves available at reasonable notice for retest dates for the guaranteed to remain effective. (ie. stating you are only available 1 Saturday every month will invalidate the guarantee).  Failure to be available to retake a test within 12 weeks will invalidate the guarantee.
  • If the pupil refuses three reasonable test dates, then the guarantee will be invalidated.
  • If you wish to upgrade the course you must pay the difference between the cost of the practical test and the deposit for the course of your choice.
  • There is no cash alternative.
  • To qualify for the free further training - you must have reached the test standard and have taken the driving test at the end of your course.
  • We will only alter the test as part of another course.
  • If you cancel a lesson for any reason with less than 48 hours notice you must pay £90

  •  to rearrange the lesson.


Other terms

1.1 We reserve the right to change these terms and conditions at any time. Any such changes will take effect when posted on this website and it is your responsibility to read the terms and conditions on each occasion you use this website and your continued use of the website shall signify your acceptance to be bound by the latest terms and conditions.

1.2 If you are not the pupil, you confirm that you have authority to bind any business on whose behalf you use this website.

1.3 All courses must be booked online via our website and non-refundable deposit payment must be made at the time of booking to secure the booking.

All course arrangements are confirmed by email, sent to the email address you used to register.

It is your responsibility to check your emails.

If after booking you have received no emails within 48hrs you must contact us.

All Courses must be completed within 6 calendar months from the original commencement date.

(If any part of the course has been carried over)

If this 6 calendar month period is exceeded all fees are forfeit and no further tests will be booked. All tuition hours will also be forfeit.

1.4 Your theory test must be booked at least 14 days prior to the course start date if you were to fail you may not be able to take a practical driving test at the end of your driving course if another theory test cannot be taken.

1.5 If Just Drive cannot provide a driving test within the same week as your driving course then we will book the next available date provided by the DSA that best coincides with your instructor's availability and yourself. 

  • We aim to book your driving test at the nearest Practical Driving Test Centre to you, however, if this is not possible we will locate a test at an alternative centre within a reasonable driving time. We do not specify which test centre you will take your test at.
  • The pupil will be permitted to use the training car for their driving test providing the pupil has reached a safe standard of driving. Whilst every effort is made to get the pupil to test level, and to take the practical test if it is considered by the instructor that the pupil could be a danger to themselves, the DSA examiner or to the general public, then for safety reasons, he/she will not be allowed to use the training car for the test and will be advised accordingly.

Just Drive cannot be held responsible if your course is affected in the following circumstances:-

  • The DVSA cancelling a driving test due to Unavailable Examiner, Examiners taking strike action.
  • Bad weather, failing light etc.
  • Any Unforeseen mechanical failure. Any accident while on a lesson or test.

1.6 If the pupil is found to be under the Influence of Alcohol, Drugs or anything which could affect your driving, the pupil would not be allowed to drive for that day losing any fees for that day's training or test fees if on test day. The instructor's decision on this is final. If you are on a guaranteed pass course you will have to pay for the next driving test & lessons for that day.

Note - If a second incident occurs then the course will be terminated with loss of all course fees.

If you decide not to attend a driving test for any reason you will be liable for the next test fee.

If the pupil falls ill within the 3 working day test cancellation notice period, the test fee will be forfeit and the pupil will have to pay for any subsequent test.

Due to the nature of intensive courses, if the pupil falls ill, during the course, any remaining days may be forfeit if the pupil is unable to continue. (this subject to the discretion of the instructor, whose decision in these instances is final).

1.7 Where the instructor may arrive late for a lesson due to circumstances beyond his/her control, the instructor will make efforts to extend the ‘finish' time of the lesson by the same amount of time or add the time on to the following session.

1.8 Where the pupil fails to attend a pre-arranged course time, the instructor will wait a maximum of 30 minutes before leaving. This will be then classed as a no show for which the pupil will be liable for a no-show fee which is equal to that day's lesson price.

1.9 All ‘Just Drive' instructors are Fully Qualified DVSA Approved Driving Instructors (DSA ADI),  who have been CRB checked.

1.10 Just Drive may substitute another instructor if unforeseen circumstances arise.

1.11 All Just Drive. vehicles are a non-smoking environment.

1.12 The cost of the use of the training car for the driving test period is the same as the cost of a lesson, if a lesson is booked prior to the test on the same day this will be the equivalent cost of a two lesson period.

1.13 Abusive language or threatening behaviour to any Just Drive Driving Instructor, office staff, DSA Examiner or the general public while on a driving lesson, driving test, or via a phone call will not be tolerated. Any such action may result in your course being terminated resulting in the loss of course fee.


2. The Booking process

2.1  All bookings made either via the website or by phone indicate acceptance of these terms and conditions

2.2 The 'confirmation' stage sets out the final details of your booking. A booking is not seen as confirmed until you have received the relevant confirmations. We will send you a booking confirmation email detailing the course you have chosen.

It is your responsibility to check your emails regularly for confirmation details and tests.

2.3 Acceptance of your booking and the completion of the contract between you and Just Drive will take place only if you have completed all relevant sections on the booking form correctly and you have made the correct payment for the course you have chosen. 


3. Payment

3.1 You must pay the relevant non-refundable deposit for the course you are booking now and the balance payment either by PAYM on the first day of the course,  or by BACS no later than 7 days before commencement of your course.

If the deposit payment is not paid within 72hrs of registering on the site we will delete your booking and it must thereafter be reentered for the dates available at the time of rebooking.  

3.2 Any remaining balance must be paid to your Instructor iby PAYM on the first day of your Driving Course.

3.3 Booking of tests: -  If we are required to rebook tests for any reason, we at present charge

  • £75 for a weekday practical test,
  • £90 for a weekend practical test.
  • We reserve the right to request an extra £13 if a Saturday test is booked.

3.4 The price you pay is the course price displayed on this website at the time we receive your booking apart from the following exception: Whilst we try and ensure that all prices on our website are accurate, errors may occur. If we discover an error in the course price you have booked we will inform you as soon as possible and give you the option of reconfirming your booking at the correct price or cancelling it. If we are unable to contact you we will treat the booking as cancelled. If you cancel and you have already paid, you will receive a full refund.

Any liability on the part of Just Drive is limited to the Deposit payment of any course.


4. Cancellations, Rearrangements & Refunds

4.1 Deposits and block booking payments are non-refundable.

(Once the booking process commences, the student receives access to instructor contact details and vice versa)

4.2 When an Intensive Driving Course is booked and Just Drivel has not received written cancellation either by post or confirmed email at least 14 days prior to the course start date then the balance payment of the course will still be owed to your Instructor who with our assistance will take the appropriate action needed to collect this amount.
4.3 A minimum of 6 weeks notice must be given for us to consider the change of course week once booked.

4.4 If we are unable to allocate an instructor to your course, we will try to give a minimum of 1 months notice of this.

4.5 Once the lessons are booked for the intensive course can not be changed, cancelled or rescheduled.

4.6 If the Pupil chooses a course and/or chooses to end the course for any reason/s before all hours are completed then Just Drive/instructor will not be held responsible for this decision and any monies paid will be lost.

4.7 For any course rescheduling requests due to medical reasons, we will require a doctor's sick note.

4.8  Refunds of the balance payment, (if paid in full at time of booking) will only be considered if put in writing and Just Drive receives this by letter or confirmed delivery email 28 days before your course start date.

4.9 An Administration charge of £50 will be applied to any refund.


The law applying to Terms and Conditions

These Terms and Conditions are governed by the laws of England and Wales.


Use of personal information

Information about yourself that you provide to Just Drive, and/or your Instructor (whether or not under our contract (or contracts) with you) may be used to:

  • Identify you;
  • Help administer, and contact you about improved administration of, any accounts, services and products provided to you;
  • Trace debtors, recover debt, prevent and detect fraud, and to manage your accounts or insurance policies; and check your identity to prevent money laundering unless you give us other satisfactory proof of identity;
  • Carry out marketing analysis and customer profiling (including with transactional information) and create statistical and testing information;
  • Help identify accounts, services and/or products which we feel may be of interest to you. We may do this by automatic means using a scoring system, which uses the information you have provided, any information we hold about you, and information from third-party agencies (including reference agencies);
  • Contact you in any way (including mail, email, phone, visit, text or multimedia messages) about products and services offered by us and selected partners. 
  • We may allow other people and organisations to use the information we hold about you for the purpose of providing services you have asked for, as part of the process of selling one or more of our businesses, or if we have been legitimately asked to provide information for legal or regulatory purposes or as part of legal proceedings or prospective legal proceedings. From time to time, these other people and organisations may be outside the European Economic Area in countries that do not have the same standards of protection for personal data as the UK. 
  • We may monitor and record communications with you (including phone conversations and emails) for quality assurance, legal, compliance and training purposes. 
  • We may check your details with fraud prevention agencies. If you provide false or inaccurate information and we suspect fraud, we will record this; and
  • Allow our selected partners to contact you about products and services offered by them. They will only contact you in this way if you have previously indicated your consent.
  • We ask successful pupils for a photograph/video review when they have passed their test. By agreeing to this, you are allowing us to use the photograph/video in our testimonials review section and elsewhere as promotional material.

Vouchers – Terms and Conditions

  • Driving lessons are only available to those who hold a valid UK driving licence.
  • Your instructor reserves the right to refuse to provide you with tuition or to cancel any lessons you have booked if you fail to provide him/her with the appropriate licence prior to your first lesson.
  • Just Drive do not guarantee a specific instructor, vehicle, or lesson time will be available.
  • Always keep the voucher in a safe place as it cannot be re-issued if lost or damaged.
  • The voucher is valid until the date showed and must be redeemed by that date.
  • The voucher has no cash value.
  • The voucher is non-refundable.

Gift Vouchers

  • With gift voucher purchases the numbers of lesson stated on the voucher are guaranteed only in the postcode stated on the voucher. Lessons taken in a different area may result in less than the stated number of lessons being available.
  • Gift vouchers are subject to availability and instructor coverage in your area.
  • Gift vouchers are for the individual named on the voucher and are not transferable.

Cash Vouchers

  • Cash vouchers provide a cash value towards driving lessons with Just Drive only.
  • Cash vouchers can only be purchased online.
  • Cash vouchers can only be redeemed online.

Introductory Offers – Terms and Conditions

  • Introductory offers are only available to new customers with Just Drive.
  • Only one introductory offer is allowed per customer.
  • An introductory offer includes a 2-hour beginners lesson in a manual car only. In this beginners lesson, you will learn about the controls of the car before progressing to moving off and stopping the vehicle.
  • Just Drive reserves the right to remove or amend any introductory offers at any time. Details of our current offers can be found on our website.

Short notice test bookings – Terms and Conditions

A short notice test is when there are two weeks or less from the date of the first planned lesson to the booked test date. Before making a booking or taking payment for a short notice test please be aware of the following terms and conditions:

  • Booking of a Short Notice Test package consists of 5 hours worth of driving instructor and tuition vehicle time.
  • During the first 2 hours, you will be assessed by your driving instructor. If after the initial two-hour assessment the Driving Instructor tells you that you are not ready we will not take you to test.
  • If you need additional tuition prior to the test the Driving Instructor will explain this to you. You will need to be available for the time slots he/she is available should you wish to take these lessons. If you cannot take the required hours we will not be able to take you for the test.
  • You will need to pay for five hours of tuition prior to the first lesson commencing which is not refundable if the driving instructor says you are not ready for test; however this can be used for further tuition.
  • The Driving Standards Agency stipulates that you need to give three clear working days to cancel your test. This may mean that you may / will lose your Driving Standards Agency test fee if the Driving Instructor says you are not ready for test dependent on the gap between first lesson and test.
  • If you change your mind after you have made a short notice test booking and wish to cancel your booking, our standard terms and conditions apply with a minimum of 48 hours’ notice required prior to the lesson.
  • This offer cannot be taken in conjunction with any other offer.
  • The lesson price is at the standard rate for tuition with your Just Drive Driving Instructor.
